Unfortunately, this is a loaded question because one portion of the question is 100% legal and then one portion of the question is 100% illegal. So, let me explain. You can purchase mobile phone numbers. There is many data brokers that are out there that will sell you mobile phone numbers. On the other hand, you cannot text message those phone numbers because it is illegal. So, while you can, yes, buy mobile numbers, you cannot text message those phone numbers. Now why can’t you text message those phone numbers and why is it illegal? Well, here in the United States, we have the FCC. And FCC developed federal law called the Telephone Consumer Protection Act. It’s pretty long but some people call it the TCPA. And essentially, it says you cannot text message consumers without their consent. And it has to be prior consent. It can’t be consent after the fact because that’s really not consent, I think. So, in the TCPA, it’s very clear that you cannot text message customers without their consent. Now, if you do text message customers without their consent, so let’s say you purchased a list of mobile phone numbers, and you text message those phone numbers, that would be text messaging people without their consent. Now, if you do that, under the TCPA, which is federal law, consumers have the right to sue your business for anywhere between $500 and $1,500 per text message. Now that’s not text message you sent out. So if you send 1 text message to a million people, you’re not gonna be sued $500 to $1,500, you’re gonna be sued for a million times $500 or $1,500. So you can see that buying phone numbers, while that is usually cheap, the consequences of buying mobile phone numbers and then text messaging those phone numbers can be in the millions or hundreds of millions of dollars. So you do not want to buy mobile phone numbers and text message them because while it is legal to buy the phone numbers, it is 100% illegal to text message those phone numbers that you purchased that never gave your business consent to send text messages to them. So hopefully that answers the question as to, “Can you buy mobile phone numbers for text message marketing?”
There is no other method that comes close to SMS in terms of reach and reliability. And that goes for their open rates as well. Clients can easily skip over a social media or mobile app push notification that appears briefly on the screen and then disappears. Emails are rarely even opened and when they are, it may be long after the event or promotion you were advertising took place.
On the home page, it has the claims of being the “secret mobile marketing weapon revealed” and “how to get the leads coming to you”. If you are experienced in digital marketing, you definitely would agree that a lot of businesses that sell products seem very convincing and even while they may not often deliver the exact product as expected, they sure do a good job at selling themselves.
With text messaging, you eliminate the reliance on luck for your message to be seen or heard -- it’s simply not enough to hope someone looks at a billboard as they walk or drive by, or that they happen to be tuned in the moment your television ad runs. The days of having to wave the brightest flag are ending as marketing becomes smarter, more sophisticated and better-targeted. With SMS text messaging and picture messaging, you now have control over exactly who receives your message and when they receive it. On top of that, it’s simple to use -- EZ Texting’s platform allows you to log in from anywhere on any device. Select your contacts, compose your message, and send. Your clients’ opted-in SMS contacts are attentive, loyal fans -- 64% of all consumers are likely to have a positive perception of a company that offers texting as a service channel -- good news for your clients. Treating them to exclusive alerts, sales and promotions will only strengthen the relationship, enhance their loyalty, and help your client’s brand steadily grow.
For example, it cost $99.95 to purchase 3,245 successfully delivered RVMs. We can normally deliver RVMs to about 70% of the numbers that are dialed. If you send us a list of 7,700 numbers, chances are that about 60% of them (4620) are cell phones. If we are able to successfully deliver RVMs to 70% of them that would be about 3234 successfully delivered RVMs. That is just 13 less than the amount you can purchase for $99.95.
Remember to incorporate your SMS marketing effort as part of your overall marketing plan. Ring activity on the greater part of your marketing items, print and advanced, welcoming clients to join your SMS hover by messaging a message or code to your telephone number (in return for a rebate, complimentary gift, or another reward). This will widen your client base and also expanding deals.
Dunkin Donuts revived some of their failing stores with an SMS campaign that they advertised through online ads and radio. The campaign rewarded customers for sharing the text offers with their friends. By encouraging sharing and word-of-mouth in their promotion, they leveraged their spending on their SMS campaign and managed to provide sufficient incentive that 17% of those who received texts forwarded them and 7,500 people opted in to their loyalty program. The result was a 21% increase in store traffic. Impressive results.
Traditionally, agencies have relied on old-fashioned channels for advertising, resulting in a madhouse of billboards, emails, television and radio ads, all competing in unison to be heard or seen by your clients’ target audience groups. But email open rates have plummeted to a lackluster 22%; radio and television ads are expensive for clients and unreliable as a method of engagement; direct mail gets lost and has an open rate of only 2-5%. It’s time to update your clients’ marketing methods -- and luckily, that means simplifying the way they think about and approach prospect outreach.
The system default setting is to not scrub against the national or any state DNC registries. Since you are not dialing a number, conducting a call over a landline or cellular network, and not causing a phone to ring, it is not necessary to scrub against DNC registries. However, if you want us to change the settings for your account to scrub against them, just let us know.
As the name implies, shared virtual numbers are shared by many different senders. They’re usually free, but they can’t receive SMS replies, and the number changes from time to time without notice or consent. Senders may have different shared virtual numbers on different days, which may make it confusing or untrustworthy for recipients depending on the context. For example, shared virtual numbers may be suitable for 2 factor authentication text messages, as recipients are often expecting these text messages, which are often triggered by actions that the recipients make. But for text messages that the recipient isn’t expecting, like a sales promotion, a dedicated virtual number may be preferred.
In Europe the first cross-carrier SMS shortcode campaign was run by Txtbomb in 2001 for an Island Records release, In North America it was the Labatt Brewing Company in 2002. Over the past few years mobile short codes have been increasingly popular as a new channel to communicate to the mobile consumer. Brands have begun to treat the mobile short code as a mobile domain name allowing the consumer to text message the brand at an event, in store and off any traditional media.

USE SHORT CODES EXTENSIVELY : A shrewd way some top business marketers gets subscribers for their SMS campaign is through the use of short codes. What you simply do is to ask your people to send a code to a customized number to get something of value from the service you render. This might be them getting a discount on a sale, getting a bonus or even ordering a product through that means. Meanwhile your system adds such persons’ phone numbers to your database. It becomes a win-win scenario. You get the subscriber, they get the value you offered and everyone is happy.
In the article cited at the beginning of this post, the author boldly claims that “a major chunk of the population is already registered with the DND.” First, there is no clear statistical research backing up this assumption. Second, in the U.S., the Do Not Call registry protects consumers from just that — unwanted calls. It’s designed to prevent telemarketers from harassing consumers. This has absolutely nothing to do with text messaging. Now, if for some reason you do find yourself receiving unwanted text messages, you can file a complaint. But, knowing the permission-based nature of this marketing method, you may never confront this issue.
The idea is that by collecting a database of subscribers we are obtaining their prior permission before we actually send them any marketing information. It means the people you send to will already know you, they have already told you they are interested in what you have to say. It’s called permission marketing, loads of books have been written on the subject, if you want one try Permission Marketing by Seth Godin.
Due to the dynamic nature of (SMS/MMS) marketing technology and the messaging industry, the Messaging Compliance Rules are constantly being updated from time to time. As a result, I’d strongly encourage clients to review vendors’ terms and conditions and proposed use cases with qualified legal counsel to make sure that they comply with all applicable laws.
